India's children suffer in brutal conditions

Editor's Note: Anti-trafficking expert Siddharth Kara is the author of “Bonded Labor: Tackling the System of Slavery in South Asia,” providing the first comprehensive overview of bonded labor in South Asia.

During the CNN coverage of my last major research trip for my new book on bonded labor, I wrote an article about my findings of debt bondage, human trafficking, and child labor in several construction projects for the 2010 Commonwealth Games in New Delhi.

Thousands of workers had been trafficked into Delhi by labor contractors to complete the massive construction projects for the Games at minimal cost.

These findings proved consistent with much of the construction sector across South Asia.

In fact, the labor conditions for the Commonwealth Games in 2010 were shockingly similar to those almost 30 years earlier when New Delhi hosted the Asian Games.

Those games became the subject of the first ever Supreme Court Case in India relating to bonded labor, People’s Union for Democratic Rights vs. Union of India and Others, 1982. Despite a resounding denouncement by the court against bonded labor, three decades later, little had changed.

Construction, like many other industries in South Asia, promotes exploitation by virtue of apathy, custom, corruption, and greed. There is also a particular impunity built into the system of construction labor contracting that is especially effective at promoting trafficking and bondage.

After winning a bid for a project, major construction companies often subcontract the labor recruitment and management to jamadars. These are labor recruiters who offer advances to peasants across India in exchange for working on the project.

Entire families can be recruited with the promise of good wages and conditions, but on arrival, the laborers can be severely exploited.

The jamadar pockets the funds he is supposed to disburse for wages, shelter, food, and medicine, and then typically kicks some of this back to the construction company that hired him.

The laws across South Asia relating to the concept of vicarious liability do not capture the relationship between a construction company and its independent contractors, so it is very difficult to hold the companies liable for the behavior of their subcontractors.  As a result, construction workers often suffer extreme abuse.

“We are treated like cockroaches,” a laborer named Rashmi told me, “It is not just the jamadars—the government has betrayed the people. We are like dogs in the street scrounging for food and shelter. They promise us wages, but we have been here five months with no wages and barely enough food to eat. I feel no human dignity.”

Two sectors that feed directly into the construction sector - stones and bricks - are just as exploitative as construction.

Millions of the most destitute peasants in South Asia are recruited each year into back-breaking work bashing stones or baking bricks to be used in construction projects.

In the city of Faridabad, I documented bonded laborers who hammered away at giant granite boulders in the same quarries that were the subject of the second Supreme Court case in India that dealt with bonded labor: Bandhua Mukti Morcha vs. Union of India and Others, 1983.

Despite a blistering indictment by the court, 30 years later many of the same conditions of bondage remained.

With bricks, peasants work 14 or more hours a day in highly dangerous conditions baking bricks in a kiln that seethes at 1000+ degrees Celsius.

The peasants often migrate to the kilns each year, perpetually seeking to pay off loans that almost always seem to grow.

When a bonded laborer named Gurahu attempted to flee from his insurmountable debts, the brick owner’s men tracked him down, punished him with electric shocks, and sold his daughter to a trafficker as punishment.

“I could not believe God had done this,” Gurahu told me. “I wanted to take my life. You cannot imagine how much pain I felt. I never saw my daughter again.”

The sub-human working conditions and barbaric exploitation inherent to the system of bonded labor remains a shameful scar on the face of South Asia. My final article will detail how we might bring these injustices to an end.

    Super good example of what happens if you dont overthrow your bank and democratic and republican puppets, like Iceland did. This is the end result. This will soon be American children as well. The world is shrnking economically and only the top ercentage will come out while you die to get food. This is the same nation that declared Mars exploration from its elite. They have one of the hugest gaps of class and this is 100% Funded by exploitation, and usually from US best friends club England. Enjoy that fail.

Estimators say, over four million children go to bed with out food every night and wait for the school meal the next day. I know it is a free country but bashing a religion that you don't know the in and outs of is not very clever. Especially, when there is no clear fact or link to relate child labor to worshiping cows.

However, us having the best law and order is not true in any shape or form. I must remind you of our increasingly high crime-rate, faulty judicial system and very uneven nation-wide rules.

        Now back to the main point: Child-labor was embedded in India's work force 100s of years ago. It was even promoted by the British government in the form of construction laborers and home-servants. Yes, the judicial system is mostly to blame for this existing problem but it can only be uprooted if the country's society believes it to be a serious problem. Things have changed in India but the progress has been very slow, yet gradual. It will take another 10+ years for the new generation to take over office and implement such human values.

        I can easily see this happen in the US as it illegal population grows. The illegals are already used as slaves and it will get worst as the population increases. Seems every day more and more forgien strange cultural behaviors and crimes are taking place in our communities. The deffinition of American culture is being over taken by primitive and less humane cultures.
        The so called better life for most is nothing than a more brutal life than they left behind.
        Our childfren and grand children will have a completly different kind of American.. that we of the baby boomers will not even recognize...as America.

        It's already happening in the US....there are human traffickers in the US just as around the world. Last year they broke up human trafficking that was happening in New Jersey. This is not a problem of just under developed countries. It's just happens to be more apparent because laws are less strict in poorer nations.

        Honey, India is a country of several ancient religions, NONE of which believe in "creation." Hinduism preached evolution before the Western world came to grasp the concept. Creation is a concept in Christianity, NOT Hinduism/Jainism/Buddhism/Sikhism etc. Get yourself educated before you spew hate.

The British – euphemism for blood suckers , looters – stripped away everything that was left from India and ancestors of the so called british royalty destroyed every royal in India, built their empires, lived off the poor, raping the women, forcibly converting hindus at gunpoint and beheading and publicly hanging, raping those who did not. Such are the British. They went to america did the same thing there too. As slavery was the way they ruled, they gave america the concept of slaves. it took america 100s of yrs to get away from slavery. Now tell me. you don't seem to know your own country's history till a few yrs back, and you call yourself an expert in world history. WOW. kudos to you homeschooler. maybe you need to come out of your homeschool and take a good look around you.

        Dear HomeSchool23, I am not sure what the 23 means – evidently, 2 to 3 years of home schooling – as reflected in the inanity of your post. You post reflects an appalling ignorance of Indian history, especially the colonization of India. India was at one point of time 30% of the world's economy, get that? – and one of the most peaceful countries – the land of the Vedas, the Buddha and Gandhiji. 800 years of mughal islamic subjugation and 200 years of English colonization and looting of India reduced it to a third-world country, and it is making a turn-around these past few years despite having the worst and most corrupt politicians in the world. I would suggest you go to regular school and get a decent education.

        You obviously have no idea about the history of India. The British treated Indians not just as their slaves but also looted all the national treasures of the country. Kohinoor -the world famous diamond which is part of the British crown came from India. The British got away with crimes such as rape and murder simply because of their race. Ever heard of the Jalianwala massacre where thousands of women, children and innocent men holding a peaceful meeting were massacred by a British General Dyer –btw he was considered a Hero in Britain and was NEVER punished for a war crime in times of peace!

        India is not full of warlords -there is a thriving democracy. There is a huge movement against corruption going on in India -and unlike in Islamic countries where the rebels are crushed or shot upon, the peaceful rebels are thriving in India.

        The silliest part of your sentence is about cow worshipping -that is what you silly people think. We respect life of all animals -cows are considered sacred because we drink their milk -it's thought of as a surrogate mother -unlike you, we cant kill and eat someone who is any roop or avatar (yes, that is the real meaning of the word) of mother. As for creation -Hindus, Jains, Buddhists and Sikhs –the 4 religions born in India don't believe in it. We believe that soul is a part of a God who just come to earth in various forms of life and once free of the series of life an death -attainable through a process called enlightenment, achieve Moksha and re-join God. We see God in every animal -most of Indians are vegetarians and don't believe in torture that you see in China -like skinning of alive dogs and cats.

      I was about to go on reading this article and then came across a glaring mistake in one of the early paragraphs..

      Zamindars (land owners and money lenders) are referred to as jamadars (people who indulged as scat disposers) -this is to huge a mistake for me to trust the article anymore.

        Exactly. One need only to look at the 57 Islam nations of the OIC. Poverty, overpopulation, and a fatalistic view on life is what Islam brings to a region. The United Nations has dictated immigration quotas in the European Union. Europe is currently being flooded with people from third world countries, mainly Islamic ones. Look how quickly ghettos and "No Go Zones" popped up in working class cities of Luton, Birmingham, Malmo, and other places in Europe. Islam is a totalitarian ideology hiding behind religion. It has a lousy track record. Even it's most prosperous nations like Dubai, Qatar, Kuwait, Saudi Arabia turn a blind eye to the starvation and poverty of their Muslim brothers and sisters. Only Western, democratic, Judeo-Christian nations have offered charity and refuge for the displaced Muslims.

    All of this happens in the US and other "advanced" countries as well. As long as we live in a system where money is king, these things will continue to happen. As to the caste system, clearly the reporter has no knowledge of how it works. There are at least 1 billion people in India. Each and every one of them is part of the caste system. So, if the reporter's assertion that the caste system is responsible for forced labour, then there should be 1 billion Indians should all be doing forced labour and nothing else. And there will be a few who are doing absolutely nothing except forcing people to work and/or handing out punishments. Anyone who has been in India for even one minute knows that most Indians do not live under such conditions.

      Saying a caste system is responsible for slavery is not the same as saying everyone in a caste system is a slave.

      No one said 'most indians live under such conditions'...

        Saywhat, my reading comprehension is very good. Unfortunately, I cannot say the same for your level of intelligence. If a caste system is responsible for slavery, then, logically, it follows that everyone who is in the caste system is either a slave or a slave-master - unless, of course, you quality the statement, which the writer has not done. If you want to see workers being held hostage and forced to work under sub-standard conditions, take the trouble to witness the conditions under which many farm-labourers work. The Immigration department "cracks down" on the farm-owners every year, and releases a few hundred workers. And then it is business as usual again.

        Dave, ever hear of medical technology? Ever hear of logic? Ever try to comprehend that, perhaps, improved medical technology and better living conditions contribute to longer life even though the rate of birth is constant or even decreasing? The US population, for instance, increases only because of immigration. Otherwise, the US would have negative population growth.

        I've lived in the US long enough to see women and children being mistreated every single day. I see homeless and drunk people every single day. I see newspaper reports of homeless men and women being raped and murdered every day. I see news reports of famous sports coaches abusing children every day, for years and years. I see reports of priests abusing children for years and years. And yet, of course, there are stupid people who believe that nothing bad ever happens in the US!

        Yes, of course, in the US have polygamists who live their lives raping minor girls. We have Republicans who believe that abortion should not be given as a right to even a girl who has been raped.

        Watch any show like Maury, Jerry Springer or Steve Wilkos -I understand that the people who come to the show are from lower income classes- but those men just don't respect women and treat them like dirt. Women have kids and don't know who the father is. What kind of a life would such women be giving to their kids? What about people who bullied people like Amanda Todd?

        US is still the greatest nation in the world -but that is because of the inherent belief that the best man should win -irrespective of his color or background. But there are plenty of losers here.

        Your and others may me mad because walmart is hiring indians – hospitals firing indian doctors, firms hiring indian lawyers, business's and IT hiring indians....... WHO do you think is hiring these people, indians? Get a clue sport – people are hiring individuals who have talent and good work ethic (yes non-indian people who are smarter than you understand its not about black, brown, white – its about finding qualified people who actually want to work and boost the economy). You definitely fit a prototype of a trailer park hillbilly...... I dont really mean that but I would be like you if I did say that to you, wouldn't I?

      yes they do. Have you ever looked at the little factories that run in the hidden alleys of the big cities. Look there and you will see the meaning of bonded labor. What about the little girls who work for the middle class families in the cities – have you not seen a 10 year old "maid" making sure that the 6 year old gets to school – comes back from school , fed?...and what do they get paid. In any civilized society you will pay through your nose for that kind of service since they value manual labor . Maybe if you really get finicky , it may not be bonded labor because most times in cities , they don't need to work to pay back loans but even then employing a 10 year old is outrageous.

    Yes, this is a colossal failure of the Indian government. Generations of children to which our ever fighting political parties are answerable to . One thing about the Indian system is things will eventually improve but at a slow pace. This is one are where time is of the essence. Hopefully, this is something that can be fixed as soon as possible.I agree we do not have a right to be called an emerging superpower with out rectifying these unpardonable mistakes. But on the other hand, we are a free vibrant society and a democracy since our birth as a modern nation. Hopefully, this will lead us into progress in the next 20-30 years.

    Once I saw a photograph of an Indian worker covered head to toe in human excrement. He was part of the "untouchable" Indian caste and his "job" was to go down into the sewers below ground and clean them by hand. It was a heartbreaking picture. He was in his 20's, smiling, just doing his job... Makes me feel like @)$% for EVER complaining about anything in my spoiled, comfy life.

Corruption is the major cause of all Indian problems no matter what project they may think of next. I may detest China but they are way ahead of India as they are good in rectifying any flaws in society except of free speech which they learnt from the British.

      I am sorry to correct you, but free speech is not something we learnt from the british. Granted we had infrastructure ( rail, civil service, police) etc created during the British. I do not know if you are aware of our history. Look at Gautama Buddha, St.Thomas, Mahatma Gandhi etc. Who said british encouraged free speech? Why did we fight for so many years for our freedom then?

    The problem is Indian's are so corrupted to the core that it is almost impossible to change the state of the people there. Thats why India had been ruled for almost 800 years by Mughal and then 300 years by British. If anyone read Indian news, they will be shocked and depressed to read how the poor people are treated there. The crime against poor people are mentioned in small articles in newspapers and now the people are even bored of this news. This article from CNN and the movie like Slumdog Milllionaire are true projection of India. The CNN should post more news like this to get world's attention and something can be done for the people. I want to help but just don't know how to.

If you even mention the poverty they get offended. Its like a false national pride they have with all their economic success but cannot tackle issues such as Justice, poverty and corruption.

I don't know if you are aware of it but there are drug-dealers in Miami - thousands of them. How many people in Florida fight the drug-dealers on a daily basis? Less than one-tenth of one percent. How often do police arrest major drug-dealers? Less than once every ten years. But then that, of course, is not evidence of people turning a blind eye to crime, according to you, I suppose.

With a population of over 1.2 billion people there was no value that this nation could bring to the table. Their soldiers (ragtag) 1.2 million continue hiding in the trenches scared from Talibans.     I continue to read with interest the thesis presented on CNN that India is “Too Big To Succeed” in a socio-politico context. Although experts use this in an economic sense, its geo-political connotations are indeed powerful. Empowering subjugated minorities in India by splitting it into smaller states would trigger uber economic demand for western nations who have given so much financial and technology aid to India with no return to show for the investment. I concur with this approach and find the premise to be on solid footing. Central Asian States (CAS) are a case in point on this successful approach. We need to understand that India has an unmanageable large population mired in poverty and we are spinning our wheels trying to feed it. It is also too big of a geographical unit to govern and for democracy to take traction.

    Let me show the mirror to these Indian carpetbeggars so they can understand how others perceive them. First off, let us not insult religions by putting Hinduism in that category. Hinduism is nothing but a cult invented by the British East India Company in the nineteenth century.The religion was based on voodoo practices of african slaves that the Muslim invaders travelled with in ancient times. Second, and that brings us to who hindus really are..... an offshoot of illegitimate children born out of these african slaves. The dark skin and body odor of Indians today are indicative of the DNA of these slaves. Nothing personal...it is all science. Recall, how the Indian hindus were again enslaved by Europeans and transported to the Carribean Islands and South America to work in sugar plantations. The mindset of Indians are so much set in slavery they they cant pull themselves of your poverty quagmire and inferiority comple that they developed over time. The problem is these Indians are dragging the neighbors down also socio economically. We must change this equation. The way to do it is to break India into pieces so that we are able to change the mindset that is so mired in slavery.

    Come on guys... really. I am really glad and consider myself fortunate to have many privileges other Indians cannot enjoy, as should you. It is quite obvious that all these trolls here don't seem to care for any sort of intellectual discussion. All they do is flame and rage time and again accusing us of being people that we are not and of doing things that we don't do, only because their narrow-mindedness stops them from dispelling their preconceived stereotypical notions.
    Stop following suit and put your time to better use so you can be better people and serve our country with the same zeal that you are defending our country, our culture, and our religions here.

In any of these cases, your nationality wouldn't be the first thing you worried about.

Is there no respect for human beings in India? That must be why our small town in America is overrun with doctors from India.     We remain extremely appalled and highly concerned about the continued medieval cultural and barbaric social practices prevalent in the name of Hinduism in India. Much to our chagrin, the human rights organizations are either turning a blind eye towards these injustices or are being paid off to look the other way. We are particularly aware of the victims of such practices, namely, young children and women especially those women who are pregnant and are bearing a female embryo. They are being mistreated or simply sacrificed in the name of their deities. To the civilized world such atrocious behavior is repulsive and is condemned in the strongest words. We urge the Indian Hindus to immediately cease and desist from such unacceptable norms. To them we say the world is watching and will see to it that justice prevails.

    I don't know that China's internal prlbmeos are greater than India's. Both suffer from certain amounts of violent separatism, and the legitimacy of both governments is based on their ability to deliver prosperity. China has unquestionably been more efficient and successful at modernizing its military, and there's no comparison between the diplomatic clout China exercises on the world stage, and India's. China is perceived to be a player on the world stage, whereas India is only seen as a regional power.The last time China decided to poke someone was when they invaded Vietnam in 1978, and they got their asses kicked. Of course, that was 30 years ago and the PLA has improved a lot since then. However, the fact remains that the political dangers of losing a conflict are so great, that it's unlikely that China will engage in military adventurism. They know fighiting and losing a significant conflict will lead to the overthrow of the Communist Party. This is why China is so knotted up over Taiwan. They would love to invade, but they know if they lost that would be the end for the current ruling class.I think it hurts the Indians to realize how little India matters to China, and to see how far China has pulled ahead of India during the same time period. This is perhaps what fuels talk of some kind of active hatred or rivalry between the two. It makes India feel important. In the same way Canadians are always fantasizing that the US is about to take something from them. Same psychology.

    Excellent report! It resonates with me. I recall in my youth, I almost fell into the trap of bonded labor in the Chaco Argentino, on the Paraguayan border. We were doing bricks from mud mixed with grass. There was no salary, only half mortadella at the end of the day. We were supposed to work, to repay the food. I lasted one day, before I escaped into the swamps filled with yacares and snakes. I almost die from hunger. The police found me, but did not dare to touch me due to my "aristocratic looks." Thet only confiscated my precious kniwes, with the pretext that "the gauchos might kill you." As for what to do with the problem in India, I know what to do. Just pass a UN resolution to sequester the Indian presidential palace. Then sell it on auction, and buy freedom of those workers! This is what the UN Charter of Human Rights says! Invoke it! That will teach the Indian society a lesson!

    India has the second largest population in the world behind China. Islam promotes population growth for namesake and religious beliefs. Spread of Islam through population growth and takeover. India is currently experiencing a modern day battle between Muslims, Hindus, and Buddhists. Had the Muslims stayed out of India, the non-violent nature of Buddhists would have prevailed. However, Muslims are comfortable with a caste system of slavery. Look at the 57 OIC nations of Islam. Women are treated like second-class citizens who must be covered and married off at soon as possible. Everywhere Islam goes, poverty and enslavement follow. Islam has a lousy track record on planet earth.

It was this way when I was born in India 78 years ago and little has changed for the poor. Successive govts. of INdia simply did not have the integrity9they did have plenty of corruption at all levels,as now) or the political will to help the poor while the rich are by and large wallowing in a vulgar display of their newly acquired wealth, not giving a hoot for the poor.     For those Americans or 'posers' calling for the split of India need to realize that America is sitting on a time bomb itself. The South wishes to separate from the North which is so much different in principles, traditions and beliefs. I have spoken to many Southern folks from Georgia, Alabama etc. and many of them want a separate country. They fly the confederate flag and are proud of their southern traditions. So I guess Americans should first be worried about the divisions in their own country before talking about others. Peace.

    Let me show the mirror to these Indian carpetbeggars so they can understand how others perceive them.

    First off, let us not insult religions by putting Hinduism in that category. Hinduism is nothing but a cult invented by the British East India Company in the nineteenth century.The religion was based on voodoo practices of african slaves that the Muslim invaders travelled with in ancient times.

    Second, and that brings us to who hindus really are..... an offshoot of illegitimate children born out of these african slaves. The dark skin and body odor of Indians today are indicative of the DNA of these slaves. Nothing personal...it is all science.

    Recall, how the Indian hindus were again enslaved by Europeans and transported to the Carribean Islands and South America to work in sugar plantations. The mindset of Indians are so much set in slavery they they cant pull themselves of their poverty quagmire and inferiority complex that they developed over time.

    The problem is these Indians are dragging themselves and the neighbors down socio economically which is causing terrorism to take root. We must change this equation. The way to do it is to break India into pieces so that we are able to change the mindset that is so mired in slavery.

Just imagine a deity that represents a demonic image with blood dripping mouth that makes dracula look like George Clooney ! If India hasn't progressed, neither has the rest of the world, for these comments sound like they come from a time long since left behind. We are part of this planet, we are here for a short number of years and then we disappear into the ether. The more hatred we spew, the more hatred we attract. We need to re-establish common bonds of humanity and help one another towards a more peaceful just world, using our wisdom and our compassion. Some countries have made huge progress materially but they still suffer from cruelty, loneliness, isolation and mental imbalances. Others still suffer with basic human needs. We have to be more tolerant towards one another, stepping out of our ego-driven madness and seeing our common humanity. Yes, stand up and speak against injustice but we don't need to trash and denigrate one another in the process...

No pressure can work to force Indian government to stop this worst kind of exploitation of children. The culprits are influential and, in many cases, the part and parcel of Indian government. There is a need to boycott Indian goods at global scale.
